An alternative writ of prohibition was issued out of the circuit court prohibiting the Honorable William Sachtjen, Judge of the Small Claims Court for Dane county and the Quisling Clinic from further proceeding in an action entitled 'Quisling Clinic, plaintiff, v. Roger Charles Drugsvold, defendant.' After hearing, the circuit court granted a motion to quash the writ and this appeal was taken. On July 20, 1960, a summons of the Small Claims Court of Dane county was mailed by its clerk to Drugsvold requiring him to appear on August 1st to answer the complaint. The summons stated Quisling Clinic was plaintiff and Douglas Nelson was the plaintiff's attorney. What purports to be the complaint, or record of it, alleges an account for $44.30, plus interest of 95â€Âº . On the complaint the plaintiff's attorney is designated as Douglas Nelson by the Credit Bureau of Madison. There is also an authorization on a card in the record signed by Quisling Clinic authorizing said attorney the institute suit and granting him permission to remit to the Credit Bureau any monies collected and authorizing the agency to retain any interest except on written instruments for the purpose of offsetting investigational expenses.
